ANJANA MISHRA ORAL ORDER 04-01-2016 Heard learned Counsel for the petitioner and learned Counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Biraul P.S. Case No. 309 of 2015 registered for offences punishable under Sections 341, 323, 324, 307, 379 and 34 of the Indian Penal Code.
Learned Counsel for the petitioner submits that an attack was made on the informant namely Lalita Devi by the petitioner which led to certain injuries on her head as well as other parts of the body. Learned Counsel for the petitioner further submits that admittedly there was a dispute between the Gotiyas regarding construction of path way and since the informant was facing difficulties in entering into her house, she protested the said construction, which lead to the present dispute. Learned Counsel further submits that come what may, the injuries purported to have been made are not such which would have lead to serious
Patna High Court Cr.Misc. No.57473 of 2015 (2) dt.04-01-2016 2/2 consequences which is evident from the plain reading of the injury report.
Considering the aforementioned facts and circumstance and that the petitioner has no criminal antecedent and also because they are agnates, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Biraul, Darbhanga in connection with Biraul P.S. Case No. 309 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
