JUSTICE RAVI RANJAN ORAL ORDER 15-01-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 347, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted on behalf of the petitioners that there is allegation of only pushing the informant and assaulting him by fists and slaps against them though there is allegation of firing also but neither any cartridge has been recovered from the spot nor did anybody suffer firearm injury. It is further contended that the petitioners have got clean antecedents.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Pankaj Mahton @ Pankaj Mahto

Patna High Court Cr.Misc. No.918 of 2016 (2) dt.15-01-2016 2/2 and Basuki Chaudhary be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Akbarnagar P.S. Case No.83/2015, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bhagalpur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
