JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 201/34 of the Indian Penal Code.

As per the prosecution case, Bhagina of informant (deceased) executed sale deed in favour of the accused persons, including this petitioner, and some consideration money remained to be paid, which was being demanded by the deceased. The informant suspects that for the said reason this petitioner along with other FIR named accused persons committed the murder of Bhagina of informant. On the information of villager dead body of the deceased was found near a pond.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.36786 of 2021(2) dt.09-12-2021 2/2 that petitioner is own uncle of the deceased and resides in the same house having same mess. As per FIR itself the informant is not an eye witness of the occurrence and he has not disclosed the identity of villagers through whom he came to know about the accused persons. It is further submitted that after autopsy the dead body was handed over to son of this petitioner and only on suspicion petitioner has been made accused in this case. Petitioner claims clean antecedent and is in custody since 17.01.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Vaishali at Hajipur in connection with Bhagwanpur PS case No. 154/2020.
