The petitioner apprehends his arrest in Paroo P.S. case No. 88 of 2016 for the offences punishable under Section 25(1-b) a, 26 & 35 of Arms Act and under Section 3⁄4 of Explosive Substance Act.

The informant got information that some criminals had assembled at the house of Harifan Sahni. On such information the informant and other officials raided the house of Harifan Sahni but the accused persons including the petitioner manage to flee away. From the house of Harifan Sahni arms and ammunitions were recovered for which seizure list was prepared. The learned counsel for the petitioner submits that Hari Sahni @ Harendra Sahni has been granted anticipatory bail

Patna High Court Cr.Misc. No.34629 of 2017 (2) dt.11-08-2017 2/2 vide order dated 20.07.2017 passed in Cr. Misc. No. 34089 of 2017. Santosh Sahni has been granted bail by the court below. The petitioner was not apprehended on the spot and nothing has been recovered from the possession of the petitioner. The arms and ammunitions were recovered from the house of Maina Devi, wife of Harifan Sahni. The petitioner has got no criminal antecedent.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that similarly situated accused Hari Sahni @ Harendra Sahni has already been granted anticipatory bail, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Singh, learned Judicial Magistrate, 1st class, Muzaffarpur in connection with Paroo P.S. case No. 88 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
