2. The petitioner apprehends arrest in connection with Gardanibagh P.S. Case No. 623 of 2025 dated 09.11.2025, registered for the offence punishable under Sections 316(2), 318(4), 191(2), 190, 126(2), 115(2), 303(2), 119(1), 292, 352 and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that Nestiva Medicare Private Limited through its Directors Ankesh Ranjan (petitioner) and Amit Choudhary entered in a registered lease agreement wherein the informant gave his premises for running of the hospital. After few years, dispute arose between the parties and the informant registered a case vide Gardanibagh P.S. Case No. 535 of 2021 against the petitioner and Amit Choudhary for a dispute relating to rent. It is further alleged that the petitioner and Amit Choudhary wants to capture the property of the informant

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that the petitioner is the tenant of the informant. On the basis of registered agreement Deed No. 5658 of 2019 the property was given to the petitioner and Amit Choudhary, the Directors of Nestiva Medicare Private Limited on rent at the rate of Rs. 80,000/- per month. It is submitted that the petitioner has invested his money in construction and opened a hospital in the name of Jay Intel Care Hospital. It is further submitted that after some time when the hospital of the petitioner flourished, then on 23.12.2021, the informant lodged Gardanibagh P.S. Case No. 535 of 2021 against the petitioner and Amit Chaudhary and pressurized them to vacate his house. It is submitted that on 03.12.

2022, the petitioner also lodged a case bearing Danapur P.S. Case No. 1379 of 2022 against the informant and his associates, in which the police has submitted charge-sheet on 25.03.2023. Further, it is submitted that the informant is a very litigant person and prior to this, he had given his house on rent to one Dr. Pratima Singh from whom informant got vacated his house and she has also lodged a Complaint Case No. 2076 of 2020 against the informant.

The said premises is in CCTV surveillance and no such alleged occurrence took place on the alleged date of occurrence which can be verified from the CCTV surveillance. The informant has lodged three criminal cases against the petitioner and others. Lastly, it has been submitted that he has eight criminal cases against him.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Gardanibagh P.S. Case No. 623 of 2025, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIII, Patna, subject to condition as laid down under Section 482(2) of B.N.S.S..
