JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2018 The petitioner is apprehending his arrest in connection with Sahebganj P.S. Case No. 250 of 2017, registered for offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 332, 353, 307, 427, 504 and 379 of the Indian Penal Code. Allegation against the petitioner and other several accused persons is that they have blocked the road as a protest of an accident and when the police party went to pacify the matter, they were assaulted and there is specific allegation against the petitioner to snatch the wallet of a Police Officer. It has been submitted on behalf of the petitioner that he has falsely been implicated and allegation that he snatched away the walled of one of the Police Officials in the huge crowd is not possible and further there is no allegation against the petitioner to

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather this application is disposed of with direction to the petitioner to surrender before the court below and pray for regular bail, which will be considered by the court below on the basis of materials available on record and the court below shall pass an appropriate order, if possible on the same day, without being prejudiced by the order of this Court.
