Petitioners apprehend arrest in connection with Harsidhi P.S. Case No. 461 of 2015 registered under Sections498A, 304B, 34 of the Indian Penal Code. The allegation against the petitioners, who are Devar of the sister of the informant, is of killing the sister of the informant by poisoning due to non-fulfillment of demand of ear ring, Gold, motorcycle.
Learned counsel for the petitioner submits that it has come in case diary that sister of the informant was a lady of bad temperament and she herself took poison. It is further submitted that petitioners are Devar and have no concern with
Patna High Court Cr.Misc. No.53198 of 2016 (2) dt.21-12-2016 the incidence. It is further submitted that mother-in-law and father-in-law of the sister of the informant have been granted bail by this Court vide order dated 08.08.2016 passed in Cr. Misc. No. 23145 of 2016.
Considering the facts and circumstances of the case and the fact that other named accused have been granted bail by this Court, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Harsidhi P.S. Case No. 461 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Arvind Srivastava, J) Manish/- U T
