====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2026 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. The informant alleged that on 08.11.2024, at about 10 AM, all the accused named in the F.I.R. including this petitioner entered the house and started assaulting her husband and when she along with her son came for rescue, they were also assaulted and the accused persons took out Rs. 60,000/- from the bag of informant's husband.

4. Learned counsel for the petitioner submits that on account of land dispute, altercation took place between the parties, in which both sides sustained injury. Case and counter case. Allegation of assault is general and omnibus and there is

Patna High Court CR. MISC. No.26115 of 2026(2) dt.11-05-2026 2/2 no allegation of any specific overt act against petitioner. Injuries sustained by the injured are simple in nature. After investigation, police submitted final form. Similarly situated coaccused persons have already been granted anticipatory bail by this Court vide order dated 14.10.2025 passed in Cr. Misc. No. 56258 of 2025. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation, injury and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P. S. Case No. 674 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
