JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bettiah Town P.S. Case No. 865 of 2017 registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

There is allegation that petitioner along with other F.I.R. named accused and unknown persons went at the door of informant to take forcible possession of his house and in that course not only Rangdari demand was made but the informant and other inmates of the house were assaulted.

Submission on behalf of the petitioner is that there is

Patna High Court Cr.Misc. No.19269 of 2018 (2) dt.05-04-2018 2/2 counter case also and the informant as well as two injured sustained simple injury. It is also submitted that a civil suit is pending between the parties.

In my view, it is not a fit case for grant of anticipatory bail and accordingly, prayer for anticipatory bail of the petitioner stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
