Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.

As per the prosecution case, this petitioner and one co-accused namely Sonam Kumari abused and assaulted the informant with fists and when one Sawan Kumar came to rescue the informant he too was also assaulted by fists. It is

Patna High Court CR. MISC. No.27520 of 2023(2) dt.11-07-2023 2/3 further alleged that the accused persons also threw bricks and stones upon the son of Sawan Kumar due to which he sustained injury.

It is submitted that petitioner has falsely been implicated in this case due to village politics. On account of pending land dispute between the parties a simple occurrence of maarpeet took place between them. Doctor has found simple injury. Petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Banka/Court concerned, Banka; in connection with Amarpur P.S. case no 312 of 2021, subject to the conditions laid down under
