====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-06-2023 Heard learned counsel for the petitioner, learned counsel for the O.P. No.2 and learned APP for the State. The petitioner apprehends his arrest in a case registered for the offence punishable u/s 498(a) and 323 of the IPC and section 4 of the Dowry Prohibition Act.
Earlier, the prayer for bail of this petitioner was rejected vide order dated 10.11.2022 passed in Cr. Misc. No.74337 of 2019 by this Court on the ground that petitioner has not complied the order dated 04.10.2021.
The petitioner has now filed this application for anticipatory bail.
Patna High Court CR. MISC. No.31389 of 2023(4) dt.28-06-2023 2/2 It is submitted that the petitioner is now ready to make payment of Rs.1,49,000/- to the O.P. No.2 and the demand draft of the same amount has been handed over to the learned counsel for the O.P. No.2 in the Court itself.
Having regard to the facts and circumstances of the case, considering that the demand draft has been handed over to the counsel for the O.P. No.2, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Complaint Case No.139C of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
