Mr.S.M.Ashraf ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-11-2020 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant through video conferencing.

Petitioner seeks bail in CRI - 82 of 2020 (arising out of Singhwara P.S. Case No. 2 of 2020), registered from the offence under Section 364(A) of the Indian Penal Code. As per the prosecution case, son of the informant aged about 40 years proceeded from his shop at about 5:00 PM on 06-01-2020 by motorcycle to reach home with sale proceeds and two mobiles, but could not reach home and it is alleged that some unknown accused have kidnapped informant's son. It is submitted on behalf of petitioner that petitioner is not named in the FIR. The victim has not named this petitioner in his statement recorded under Section 164 Cr.P.C. In fact,

Patna High Court CR. MISC. No.23183 of 2020(3) dt.02-11-2020 2/2 petitioner is neighbour of informant and due to enmity, he has falsely been implicated in this case and petitioner is in custody since 22-03-2020.

However, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail application and submitted that name of petitioner has figured as accomplice of one co-accused Amrendra Kumar Singh, who disclosed this fact in his confessional statement. The role of the petitioner has been inter alia that of a liner, who was arrested on 21-03-2020, the date on which victim was recovered. It is further submitted that complicity of the petitioner has been corroborated in confessional statement of other co-accused persons and moreover, the victim has identified the petitioner during T.I.P. duly conducted before the Judicial Magistrate on 28-05-2020.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The bail application of petitioner stands rejected.
