Mr.Naveen Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-10-2020 Heard Mr. Naresh Prasad, learned Counsel for the petitioners and Mr. Naveen Kumar Pandey, learned Additional Public Prosecutor for the State.

The petitioners are apprehending arrest in connection with Goreakothi P.S. Case No. 212 of 2019 registered for the offence under Sections 498A, 341, 323, 324 and 325/34 of Indian Penal Code.

Learned counsel for the petitioners would submit that the petitioners are mother-in-law and father-in-law. Allegations have been leveled against the in-laws and not against the husband of the informant. The husband has filed an application under Section 9 of Hindu Marriage Act for restitution of

The petitioners being father-in-law and mother-in-law of the informant are inclined to resolve the dispute, if any, between the husband and wife and ensure restoration of normal conjugal and peaceful life at the matrimonial house but the informant is reluctant to resolve the dispute in this regard. Considering the fact that the petitioners are mother-inlaw and father-in-law and husband has not been made accused in this case, the Court is inclined to grant privilege of anticipatory bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender within a period of one month from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of CJM, Siwan in connection with Goreakothi P.S. Case No. 212 of 2019, subject to the conditions laid down under Section 438 (2) of Cr.P.C.
