JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 419, 420,467,468, 471 and 120(B) of the Indian Penal Code.

On the alleged date and time of occurrence, the petitioner being the then Panchayat Secretary and co-accused Chandani Singh being then Up.-Sarpanch opened forged account bearing no. 3110882533 in Batsa branch of State Bank of India and defalcated Rs. 35,000/- allocated to Shyamwati Devi wife of Sri Ganesh Singh for Indira Awash Yojana. It is submitted that petitioner has been made accused

Patna High Court CR. MISC. No.27421 of 2023(2) dt.11-07-2023 2/2 in this case only on the basis of suspicion. There is no specific allegation against the petitioner. As per F.I.R, it is evident that there is no role of the petitioner regarding opening of forged Bank account. It is next submitted that co-accused Chandani Singh is wrongly identified Shyamwati Devi and account has been opened in State Bank of India and petitioner is said to have assisted.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/Successor Court, Banka in connection with Dhoraiya P.S. case no 368 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
