1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 394 of the Indian Penal Code read with Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner was granted the privilege of regular bail by an order dated 26.05.2022 in Criminal Miscellaneous No. 3369 of 2022 with a condition that one of the bailors of the petitioner shall be his father, Jhapsi Paswan. It is submitted that father of the petitioner was not in a position to furnish the bail bonds, as such, a modification application being Criminal Miscellaneous No. 50834 of 2022 came to be filed, but then same was

No.36488 of 2024(4) dt.20-09-2024 2/2 permitted to be withdrawn by an order dated 28.09.2022, thereafter again a modification application being Criminal Miscellaneous No. 11256 of 2024 was filed and the same came to be dismissed by an order dated 09.02.2024 with liberty to the petitioner to file fresh bail application.

4. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.

5. Considering the submission made by the learned counsel appearing on behalf of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Muzaffarpur Town P.S. Case No. 13 of 2021.

6. Accordingly, the instant regular bail application stands allowed.
