Petitioner, who is in custody, seeks bail in connection with Runnisaidpur P.S. Case No. 201 of 2018 registered for the offence punishable under Sections 147, 148, 149, 324, 307,354,379,302 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is no any specific allegation leveled against this petitioner. It is alleged in the written report that on the date of occurrence petitioner along with other six accused persons assaulted the informant with fighter and other heavy materials in his stomach, chest etc. On account of which he became unconscious. Learned counsel for the petitioner submits that the main assailant Srichand Mukhiya tried to give a dabiya blow on

Post-mortem report has been annexed as Annexure-2 to this petition, wherein, doctor has found one abdominal wound and the cause of death was due to septicemia, shock leading to C/R failure.

Learned counsel for petitioner has submitted that from post-mortem report, the injury does not get support. It is further submitted that Srichand Mukhiya has already been granted bail by coordinate Bench of this Court vide Cr. Misc. No. 80602 of 2018 order dated 15.01.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi, in connection with Runnisaidpur P.S.
