JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-07-2019 Heard learned counsel for the petitioner as well as learned counsel for the State and perused the case diary. Learned counsel for the petitioner submits that there is no eye witness to the occurrence and petitioner's name has come in this case in course of investigation merely on suspicion as he is said to have spoken on mobile phone to Umesh Singh, who is the husband of Rina Devi, and there was illicit relation between the said Rina Devi and the deceased. Petitioner has no criminal antecedent. Learned counsel further submits that the only material collected during investigation in the case diary is that the petitioner was found in touch with the accused persons on mobile phones.

In the facts and circumstances of the case, provisional anticipatory bail allowed to the petitioner by previous order of this Court dated 23.4.2019, in connection with Chauri P.S. Case No. 53 of 2018, pending in the court of the Chief Judicial Magistrate, Bhojpur at Ara, is confirmed with the conditions entailed in the said order.
