JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 427, 353 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, in course of patrolling duty, the informant received information about blockage of NH 19 by burning the tyre and fixing wooden log on the road. The informant reached there and anyhow the blockage was cleared and 18 persons including the informant were identified. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The allegation of blocking the road and raising slogans is general and omnibus. Similarly situated accused Santosh Kumar Singh and Ravindra Kumar Singh have already been granted

Patna High Court CR. MISC. No.27257 of 2022(2) dt.22-09-2022 2/2 anticipatory bail by a co-ordinate Bench of this court vide order dated 03.10.2017 passed in Cr. Misc. No. 47031/ 2017. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town PS case No.473/ 2017, subject to conditions laid down u/s 438(2) of the Cr. P. C.
