Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhawanipur P.S. Case No. 131 of 2022 registered on 01.06.2022 lodged under Sections 341, 323, 324, 325, 307, 379, 504, 506/34 of the I.P.C.

As per the prosecution case, F.I.R. has been lodged against seven named accused persons, including the present petitioner, in which allegation against the petitioner is to assault the husband of the informant, initially by lathi in his stomach and subsequently by dabiya in his leg.

Learned counsel for the petitioner submits that both

He further submits that the antecedent of the petitioner is clean and petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 23.01.2023. Counsel submits that the major section is under 307 but injury are not on the vital part of the body. He submits that charge-sheet has also been submitted.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Bhawanipur P.S. Case No. 131 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
