Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

The prosecution case is that the informant being a teacher withdrew Rs. 34,600/- from the Bank with regard to school dress and scholarship scheme, but the said amount was roped, leading to registration of F.I.R. under Section 392 of the Indian Penal Code against three unknown. The name of the petitioner transpired during investigation but on conclusion of investigation . It appears that the charge-sheet has been submitted under Section 395 of the Indian Penal Code and consequently the order of cognizance has been

Patna High Court Cr.Misc. No.35657 of 2016 (2) dt.01-09-2016 passed.

It is submitted by the learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case. There is no recovery from the petitioner. Considering the fact that on conclusion of investigation the petitioner has been charge-sheeted, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kaler P.S. Case No. 40 of 2015, pending in the court of learned Additional Chief Judicial Magistrate, Arwal. With the above observation this application is disposed of.
