The petitioner is in custody since 16.11.2018 in connection with Rahika P.S. Case No. 47 of 2016 for the offence registered under Section 394 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was remanded in connection with the present case on the basis of self statement made before the police by co-accused persons and there has been no recovery from the petitioner. He further submits that the petitioner is languishing in jail and till date he has not been placed on T.I. Parade. He further submits that earlier the petitioner was arrested in connection with Laheriasarai P.S. Case No. 220 of 2016 for similar offence

Patna High Court CR. MISC. No.24858 of 2019(2) dt.17-04-2019 2/2 where he was apprehended from the spot along with another stolen tempo. So far as the present case is concerned, the petitioner never committed any theft nor was any auto recovered from his possession.

Considering the aforesaid facts and circumstances of the case and that no recovery was made in connection with the present case and his name has only figured on the basis of the confessional statement made before the police by other coaccused, who have named the petitioner in connection with the present case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate -1st, Madhubani in connection with Rahika P.S. Case No. 47 of 2016.
