This application is for grant of anticipatory bail for the offence under Sections 407 of the Indian Penal Code. It has been submitted on behalf of the petitioner that he was Driver of the informant but prior to occurrence, he left the job and he was demanding the back wages of two months, as such he has been falsely implicated in this case. It has also been submitted that nothing was recovered from the possession of the petitioner rather the vehicle was recovered from the Birpur Police Station of Lakhisarai district.

Heard learned A.P.P. also, who has pointed out some paragraphs in the impugned order showing that these are against

Patna High Court Cr.Misc. No.45490 of 2016 (2) dt.16-12-2016 2/2 the petitioner.

Having heard both sides and in view of the facts as stated above as well as some paragraphs of the impugned order, as referred, the petitioner is directed to surrender before the court below and the court below will consider this aspect of the matter that nothing has been recovered from the possession of the petitioner, after verifying the case diary, he will dispose of the bail application of the petitioner without being prejudice of the order of this Court same day.
