2. Petitioner seeks regular bail in connection with Barahiya P. S. Case No. 26/2023 in a case registered for the offences punishable under Sections 364, 120(B) of the Indian Penal Code.

3. As per the prosecution story, son of the informant, namely, Saurav Kumar @ Golu was driving a four-wheeler car along with his friend Avinash Kumar. Meanwhile, all the F.I.R. named accused persons, including this petitioner, abducted the son of informant and left his friend midway who narrated the story to the informant. Accordingly, the F.I.R. Subsequently, the victim was recovered and in his statement, recorded under Section 164 Cr.P.C., he has supported the prosecution story.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case merely on suspicion. He further submits that during trial, informant and the victim have been examined and they have not identified this petitioner. Moreover, similarly situated co-accused, namely, Gulshan Kumar has already been granted regular bail by coordinate Bench of this Hon'ble Court vide order dated 13.09.2024 passed in Cr. Misc. No. 44961 of 2024. Petitioner claims clean antecedent and he is in custody since 05.02.2025.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P.
