The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(a) of the Excise Act. On information that in the shop of the petitioner and others illicit liquor was being sold, raid was conducted, and the country made liquor was recovered when one Tahlu Mahto was apprehended, who disclosed the name of the petitioner as one of the persons, who escaped from the scene. From the shop of the petitioner fifty bottles each containing 200 ml. country made liquor were recovered.

No.55895 of 2015 (2) dt.09-12-2015 2/2 It is submitted by learned counsel for the petitioner that the petitioner was not present when the seizure was made and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts may constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kotwa P.S. Case No. 198 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Motihari, East Champaran.

With the aforesaid observation, this application is disposed of.
