JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-11-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner seeks bail in Forbesganj P.S. Case No. 61 of 2020 {Spl. (POCSO) Case No. 5 of 2020} registered for the offence under Sections 448, 341, 323, 354(B), 504, 506/34 of the Indian Penal Code and Section 8/12 of POCSO Act. As per prosecution case, on 22-01-2020 at about 10 PM, petitioner is alleged to have entered into the house of informant and tried to do wrong with her, but on alarm raised by the informant, he (petitioner) fled away.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. In fact, there was love affairs between petitioner and informant and petitioner has not committed any wrong with the informant and he is in custody

However, learned A.P.P. for the State has vehemently opposed the bail application and submitted that there is specific allegation against petitioner of trying to commit rape and this fact has also been supported by the victim (informant) in her statement recorded under Section 164 Cr.P.C.

Considering the aforesaid facts and circumstances, the bail application of petitioner stands rejected. (Prabhat Kumar Singh, J.) anay/- U T
