====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2026 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

3. It is alleged that on 15.06.2022, when informant and his family members were at the marriage ceremony of their neighbour's daughter, five F.I.R. named accused persons, armed with gun, reached there and co-accused Rajeev Yadav and Chandra Shekhar Yadav fired in the Mandap, due to which wife of the informant received injuries and died while being taken to the hospital.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Specific accusation of firing is against co-accused Rajeev Yadav and

There is no allegation of any specific overt act against the petitioner and he is only alleged to be member of the mob. Police after investigation submitted final form against petitioner and he was not sent up for trial, however, learned court below took cognizance against all the F.I.R. named accused persons, including petitioner. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Araria in connection with Narpatganj P. S. Case No. 278 of 2022, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
