JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 25(1-B)a and 26 of the Arms Act.
Two country made pistols and live cartridges were recovered from the fodder house of the petitioner. It is submitted by learned counsel for the petitioner that the fodder house has no door and it was outside the house, hence recovery cannot be treated from the possession of the petitioner. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Aurangabad (Town) P.S. Case No. 417
Patna High Court Cr.Misc. No.55952 of 2015 (2) dt.09-12-2015 2/2 of 2015 pending in the court of learned CJM, Aurangabad. Accordingly, the application is disposed of.
