Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Agamkuan PS case no. 76 of 2024 dated 21.01.2024, disclosing offences punishable under Sections 318(4), 338, 336(3), 340(2) of B.N.S. Act.

The prosecution story, as per the First Information Report, is that 21.01.2024, Central Teacher Eligibility Test was organized in the Litera Valley School, Naya Tola, Kumhrar by the Central Board of Secondary Education, New Delhi. On the same day, in the first sitting of the examination between 9:30 am to 12:00 am, one examinee appeared by the name of Manoj Kumar by entering his attendance in biometric in place of real examinee i.e. the petitioner. Upon verification, it was found that

Patna High Court CR. MISC. No.24977 of 2025(2) dt.05-05-2025 2/3 on the Adhar card of the petitioner, photo of fake examinee Manoj Kumar was affixed. The arrested person disclosed his name as Manoj Kumar.

Learned Counsel for the petitioner submits that petitioner's credentials have been misused by somebody, of which the petitioner was not aware. Learned counsel further submits that petitioner has already qualified in L.D.C.E. Examination, 2017 bearing Roll no. 3206167623, conducted by S.S.C., as such, the petitioner decided not to participate in C.T.E.T. examination. He also submits that petitioner was not involved in manipulation of Adhar card and the same has been used without knowledge of the petitioner.

Regard being had to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that Manoj Kumar, who was appearing in place of the petitioner, manipulated the Adhar card of the petitioner and was arrested during examination, I am inclined to grant the privilege of anticipatory bail to the petitioner. 6.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten
