The petitioner apprehends his arrest in Magadh Medical P.S. Case No.31 of 2019 registered under Section 30(a) (d) of the Bihar Prohibition and Excise Act.

The police got information about illegal preparation of country made liquor and selling on such, raid was conducted. From the house of different persons country made liquor was recovered. From the house of the petitioner, three litres country made liquor was recovered.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and a small quantity of country made liquor is said to have been recovered from the house of the petitioner.

Patna High Court CR. MISC. No.28467 of 2019(2) dt.30-04-2019 2/2 Having considered the facts that three litres country made liquor was recovered from the house of the petitioner, who is said to have indulged in preparation and selling of liquor, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
