Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioners seeks bail in connection with Special Excise No. 1173 of 2023 arising out of Kotwali (Tilkamanjhi) P.S. Case No. 223 of 2023 registered for the offence under Sections 30(a) / 32 of Bihar Prohibition and Excise Amendment Act, 2016.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedents and they are in custody since 06.03.2023 and there is recovery of 131 liters.

Patna High Court CR. MISC. No.27362 of 2023(2) dt.15-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the recovery of liquor, this application for regular bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XII-cum-Special Judge, Exclusive Excise Court-II, Bhagalpur in connection with Special Excise No. 1173 of 2023 arising out of Kotwali (Tilkamanjhi) P.S. Case No. 223 of 2023.
