JUSTICE PURNENDU SINGH ORAL ORDER 07-05-2025 At the outset, learned counsel appearing on behalf of the petitioners seeks to withdraw the present bail application on behalf of petitioners no.1 and 4 in order to seek appropriate remedy in accordance with law.

2. Accordingly, the present bail application with respect to petitioners no.1 and 4 is dismissed as withdrawn.

3. Heard Mr. Arvind Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Anuj Kumar Shrivastava, learned APP for the State.

4. The petitioners no.2, 3 and 5 to 7 seeks pre-arrest bail in connection with Mohanpur P.S. Case No. 730 of 2022 registered for the offence(s) punishable under Sections 341, 323, 324, 354, 379 & 307/34 of the Indian Penal Code.

5. As per the allegation made in the FIR, the accused persons named therein including the petitioners have assaulted the informant and outraged the modesty of the wife of the informant.

6. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and have falsely been implicated in the present case. General and omnibus allegation has been levelled against the petitioners no. 2, 3, 5, 6 and 7 and specific allegation of assault on the head and face of the informant has been levelled against petitioners no.1 and 4. Petitioners have clean antecedents.

7. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

8. Considering the nature of allegation made in the FIR to be general and omnibus and also the fact that petitioners have clean antecedents, I am of the opinion that petitioners no. 2, 3, 5, 6 and 7 have, prima facie, made out a case to be released on pre-arrest bail.

9. Petitioners no. 2, 3, 5, 6 and 7 is directed to be released on pre-arrest bail, in the event of thier arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Sherghati, Gaya in connection with Mohanpur P.S. Case No. 730 of 2022, subject to the conditions as laid down under Section 482(2) of the BNSS.
