====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Simraha P. S. Case No. 54 of 2025 registered for the offences punishable under Sections 103(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, on 26.02.2025 at about 3:45 P.M., the informant received an information through phone that her daughter, namely, Bandhan Devi, had been killed and when the informant came to her daughter's house, he found her daughter dead in her room. It is further alleged that her daughter, namely, Bandhan Devi, had got married to this petitioner ten years ago and she had given birth to two children out of the wedlock. Bandhan Devi's in-laws started pressuring her to withdraw the case and on 25.02.2025, she withdrew the case. Due to this reason, all the F.I.R. named accused persons killed Bandhan Devi by throttling her neck. After killing her, all the accused persons fled away from their house and left the deceased in the house.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, deceased had developed an illicit relationship with some other person when petitioner was out of the town to earn livelihood for his family, to which her in-laws objected and when petitioner came to know about the same, deceased committed suicide out of fear and loss of honour. From perusal of the post-mortem report, it is apparent that no external injury was found on any part of the body except strangulation meaning, thereby, no quarrel took place between the parties. Petitioner is in custody since 01.03.2025 and charge has already been framed on 25.11.2025.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, period of

The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Araria in connection with Simraha P. S. Case No. 54 of 2025.
