2. The petitioner seeks bail in Sessions Trial No. 86 of 2026 arising out of Udwantnagar P.S. Case No. 56 of 2025 registered for the offence punishable under Sections 309(6), 118(1) and 109 of the BNS and Section 27 of the Arms Act.
3. This is the second attempt for regular bail of this petitioner. Earlier the prayer for bail of this petitioner was rejected by this Court in Cr. Misc. Nos. 44682 of 2025, vide order dated 03.09.2025, respectively.
4. As per allegation in the FIR, petitioner along with other co-accused person snatched cash amounting to Rs. 1,50,000/- from the informant and also made open fire after

5. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that during investigation the alleged country made pistol has been recovered from the house of co-accused person namely Nitish Kumar and nothing incriminating articles has been recovered from the conscious possession of the petitioner. He next submits that charge has been framed but no witnesses has been examined till date. Petitioner is in custody since 10.03.2025.
6. Learned APP for the State opposes the prayer for regular bail of the petitioner.

From perusal of the FIR and impugned order of the learned Additional Sessions Judge-17th, Bhojpur, Ara dated 25.03.2026, it appears that this is the second attempt for regular bail of this petitioner. Earlier the prayer for bail of this petitioner was rejected by this Court in Cr. Misc. Nos. 44682 of 2025, vide order dated 03.09.2025. From perusal of the report regarding the stage of trial from the Court of the learned District and Additional Sessions Judge-XVIIth, Bhojpur at Ara vide letter no. 64 of 2026 dated 30.04.2026, it appears that charge has

Two witnesses out of eight have been examined as yet and the expected time for concluding the trial is almost six months and the petitioner is in custody since 10.03.2025, almost more than one year, so considering all these aspects of the case and submission of learned counsel for the petitioner, I am inclined to grant regular bail to the petitioner.
8. Accordingly the prayer for regular bail of the petitioner is allowed. Let the petitioner above named be released on regular bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-17th, Bhojpur at Ara in connection with Session Trail No. 86 of 2026 arising out of Udwantnagar P.S.
