This application under Section 407 of the Cr.P.C has been filed seeking transfer of Matrimonial Case No. 160 of 2015 filed by the Opposite Party No. 2, the husband of the petitioner under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal right, from the Court of learned Principal Judge, Family Court, Munger to the Court of learned Principal Judge, Family Court, Jamui.

Learned counsel appearing on behalf of the Opposite Party No. 2 has submitted that the parties have adduced their evidence and the evidence has been closed. The matter is fixed for argument before the Court below.

Patna High Court Cr.Misc. No.56576 of 2015 (5) dt.06-12-2016 2/2 Upon perusal of the application, I find that no case for transfer of the said matter is made out, as prayed for in the application.

This application has no merit and is accordingly, dismissed.
