JUSTICE SHIVAJI PANDEY ORAL ORDER 03-04-2019 The petitioner has earlier moved before this Court in C.W.J.C. No. 81 of 2001 for identical relief and the same was rejected vide order dated 23rd March 2007 and the same was tested in the Letters Patent Appeal unsuccessfully, but for identical relief persons have approached this Court and obtained the order in their favour.

The learned counsel for the petitioner submits that the petitioner should be granted the identical relief as that of others.

As the petitioner has approached this Court earlier unsuccessfully, res judicata applies against him. However if

Patna High Court CWJC No.22890 of 2013(2) dt.03-04-2019 2/2 others have been given relief, it is expected from the authority concerned will treat the petitioner in the same term as others are benefited.

Accordingly this application is disposed of.
