The petitioner has preferred this application for grant of regular bail in a case registered under sections 392 and 411 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that the petitioner along with one Nitesh Sahani looted the informant who was on his tractor of the articles mentioned in the F.I.R.. On hulla being raised by the informant, both the accused persons were caught and the looted articles were recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons as a result of dispute over rasta. No

Patna High Court CR. MISC. No.36679 of 2021(2) dt.04-01-2022 2/2 incriminating article has been recovered from his possession. He is in custody since 27.12.2020 and has no criminal antecedent. The case of the petitioner stands on a similar footing to that of co-accused Nitesh Sahani who has been enlarged on bail vide order dated 20.12.2021 passed in Cr. Misc. no.29367 of 2021. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year and grant of bail to the above mentioned co-accused, the Court directs the petitioner to be enlarged on bail in connection with Sugauli P.S. Case no.652 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
