This application for anticipatory bail arises out of Forbesganj P.S. Case No. 1025 of 2018, disclosing offences under Sections 147,148,149,341,303,307,353,379,504, and 506 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner has submitted that in similar circumstance another co-accused Md. Tohid has been allowed anticipatory bail by this Court by order dated 09.04.2019 passed in Cr. Misc No. 22319 of 2019.n It has also been argued that for the same occurrence two cases have been registered one by the police Personnel and other by the Junior Engineer.

Learned counsel for the petitioner has also submitted

Patna High Court CR. MISC. No.26105 of 2019(2) dt.22-04-2019 2/2 that he has been allowed anticipatory bail in the other cases,viz, Forbesganj P. S. Case No. 1024 of 2018.

Considering the aforesaid submission, this application is allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Forbesganj P.S. Case No. 1125 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
