JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 49, 341, 323, 307, 504 of the Indian Penal Code. The prosecution case is that on the order of co-accused Upendra Mandal, petitioner No. 2 assaulted the informant with lathi. The other accused persons also assaulted the informant with lathi and when his wife and other family members came to rescue they were also assaulted. It is submitted by learned counsel for the petitioners that in the background of pending title suit and land dispute the accusation has been levelled. There is counter version of the occurrence and on conclusion of the investigation, final form has been submitted. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.56086 of 2015 (2) dt.10-12-2015 2/2 petition that petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Ghanshyampur P.S. Case No. 82 of 2012, pending in the Court of learned Sub-Divisional Chief Judicial Magistrate, Biroul at Benipur, Darbhanga.
With the observations above, the application stands disposed off.
