2. The petitioner has preferred this application for grant of regular bail in connection with Jayanagar P.S Case No. 181/2022 dated 13.06.2022 registered for the offence punishable u/s 341, 323, 307 and 506 read with Section 34 of the Indian Penal Code and later on Section 302 of the IPC was added.
3. As per the prosecution case, on 12.06.2022, the informant's grandson went to Mehbari to attend the feast but he did not return. On search, it came to notice that he is admitted in clinic. When the informant reached there, he found his grandson severely injured. It is further alleged that the petitioner and the co-accused persons along with 8-10 unknown persons assaulted
Patna High Court CR. MISC. No.28655 of 2025(2) dt.10-07-2025 2/3 his grandson and threw his body. Further, it is alleged that earlier on 01.06.2022 accused persons also assaulted him and threatened to kill him.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up on mere suspicion. The petitioner has neither concern with the deceased nor he is involved in any manner in the crime alleged. The other co-accused person has already been granted bail by this court vide order dated 27.04.2023 passed in Cr. Misc. No. 3298/2023. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. As per the post mortem report, the cause of death is due to intracranial hemorrhage, compression and shock, caused by hard and blunt substance. As per para. 44, 45 and 46 of the case diary, the petitioner and the co-accused persons along with 7-8 unknown miscreants was seen assaulting the informant's grandson.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners
Patna High Court CR. MISC. No.28655 of 2025(2) dt.10-07-2025 3/3 above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhubani in connection with Jayanagar P.S Case No. 181/2022.
7. The application stands allowed.
