JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Dinara P.S. Case No. 130 of 2016 registered under Sections366A/34 of the Indian Penal Code. Petitioners are named in the first information report but according to first information report itself, it was co-accused Rahul Kumar Lal, who took the victim. Petitioner No. 1 happens to be mother whereas; the petitioner No. 2 happens to be brother of aforesaid co-accused Rahul Kumar Lal. However, in course of investigation, it came to light that it was co-accused Rahul Kumar who took the victim.

Patna High Court Cr.Misc. No.43159 of 2016 (4) dt.20-12-2016 2/2 No doubt, the victim has not been recovered, as yet but considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Dinara P.S. Case No. 130 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
