The petitioner apprehends his arrest in Jhanjharpur P.S. Case No.23 of 2017 registered under Sections 379, 511, 401, 468, 471 of the Indian Penal Code.

The learned counsel for the petitioner submits that on the basis of fardbeyan of Pappu Kumar Chaudhary, the present F.I.R. was lodged. On chase, Beeru Kumar Yadav was apprehended and he disclosed the name of Sukhlal Yadav who managed to flee away from the place of occurrence. Beeru Kumar Yadav did not disclose the name of the petitioner. It is submitted that name of the petitioner figured in the confessional statement of co-accused but save and except this fact, there is no recovery of any stolen articles from the house of the petitioner.

Patna High Court Cr.Misc. No.25753 of 2018 (2) dt.04-05-2018 Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Jhanjharpur in connection with Jhanjharpur P.S. Case No.23 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
