The petitioners apprehend their arrest in connection with Saharsa Sadar P.S. Case No.730 of 2021, registered for the offences punishable under Sections 420, 467, 468, 471, 120B, 384 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioners have got one criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is admitted land dispute between the parties. It is submitted that the petitioners had no knowledge about the land dispute between informant and

Patna High Court CR. MISC. No.28173 of 2022(2) dt.06-09-2022 2/2 Bindeshwari Ram. It is also submitted that a title suit being Title Suit No.363 of 2021 is pending between the parties and the dispute is civil in nature.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Taking into consideration the facts and circumstance of the case, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa in connection with Saharsa Sadar P.S. Case No.730 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
