The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364/120B/302/201/34 of the Indian Penal Code. Deceased Shubham Kumar had love affairs with the petitioner. Allegation is that the petitioner in collusion with her another lover committed murder of Shubham Kumar. Eyewitness Saurabh Bharti, who was friend of Shubham, gave his statement under Section 164 Cr.P.C. wherein he stated that the named three persons took Shubham Kumar from the auto rickshaw on which Shubham and this petitioner were going and carried towards the river side and they committed murder by assault.
Patna High Court Cr.Misc. No.52954 of 2016 (3) dt.23-02-2017 2/2 Submission of the petitioner is that the other named accused had no affairs with the petitioner nor the petitioner was involved in the murder of deceased. The petitioner is an unmarried girl.
Considering the entire facts and circumstances of this case especially the fact that there is no substantial material against the petitioner and the petitioner is a female, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Ms. Raghawendra Narayan Singh, Judicial Magistrate, 1st Class, Danapur, Patna/Successor Court in connection with Bikram Police Station Case No.152 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
