JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act. .
As per the prosecution case, while the informant was in his shop this petitioner demanded some articles and when informant demanded price of articles petitioner refused to pay the same and for which some altercation took place. Thereafter, it is alleged that this petitioner along with FIR named accused persons, variously armed, came on three motor cycles and started assaulting the informant. It is further alleged that they made indiscriminate firing on the shutter of the shop and fled away but on chase two accused persons were
Patna High Court CR. MISC. No.36793 of 2021(2) dt.09-12-2021 2/2 apprehended by the villagers and handed over to the police. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is general and omnibus allegation of firing against this petitioner and no injury is caused to the informant. Petitioner is in custody since 13.01.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Rohtas at Sasaram in connection with Nokha PS case No. 71/2020.
