The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

334 quintals of rice and 1.5 quintals of wheat were recovered from the godown of the petitioner. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The petitioner being grain dealer has kept the grains which are not controlled item and the seized grains were directed to be released in favour of the petitioner vide order dated 24.11.2015 passed in C.W.J.C. No. 17006 of 2015 by a coordinate Bench of this Court.

No.55915 of 2015 (2) dt.09-12-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 498 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
