The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47a of the Excise Act. It is alleged that 300 bottles, each containing 200 ml., country made liquor were recovered from the Ranjeet hotel, alleged to be of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner in no way connected with the alleged Ranjeet hotel. In fact, the petitioner and one Shankar Kumar Gupta took the alleged land on lease from one Renu Kuer, wife of late Ashok Kumar Gupta to run a mobile shop on the same. Hence, recovery cannot be treated from the possession of the petitioner.

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Dehri (T) P.S. Case No.455 of 2015, pending before the learned Judicial Magistrate, 1st Class, Dehri-on-Sone, Rohtas. With the above observation, this application is, accordingly, disposed off.
