JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 15-12-2016 Heard the counsel for the petitioner and the State. The case was lodged in July, 2015 under section 363-A IPC naming the petitioner whereas the present application for anticipatory bail has been filed recently in this Court. According to the FIR, the niece of the informant aged about 14 years was forcibly kidnapped/abducted by the two accused persons, including the petitioner. On a chase, the victim was recovered with another co-accused whereas the petitioner managed to flee away therefrom.

The contention of the petitioner is that at the trial the informant has stated about the love affairs going on between the victim and the co-accused. The petitioner was not arrested at the

Patna High Court Cr.Misc. No.48142 of 2016 (2) dt.15-12-2016 2/2 spot.

Learned APP, on the other hand, points out that for the last several months the petitioner did not submit to the jurisdiction of the court and evaded the trial which is already underway. The victim girl has not been found major by the court. Considering the above, I am not inclined to grant bail to the petitioner. Prayer is accordingly rejected. (Kishore Kumar Mandal, J) HR/- U T
