Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner is apprehending her arrest in a case registered under Sections 420, 406, 467, 468, 471, 120B/34 of the Indian Penal Code.
Allegation is that the accused persons embezzled the public money of MGNREGA.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Due to personal grudge and political rivalry the
Patna High Court CR. MISC. No.24947 of 2020(3) dt.22-01-2021 2/2 present case has been instituted. It has further been submitted on behalf of the petitioner that the petitioner is ready to deposit the amount of Rs.5,00,000/- (Five lacs) in the court below, which shall be subject to final disposal of the case. On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, the petitioner is directed to deposit the amount of Rs.5,00,000/- (Five lacs) in the court below, which shall be subject to final disposal of the case. On doing so, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of eight weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IVth, Buxar in connection with Simari P.S. case No.180 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
