====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-01-2022 Heard learned counsel for the parties through video conferencing.

The petitioner, who is lady, seeks bail in Sarai P.S. Case No. 178 of 2020 registered for the offence under Sections 302, 120B, 34 of the Indian Penal Code.

As per the F.I.R., the prosecution case in brief is that on 04.08.2020 at about 7.45 PM, while the informant alongwith his brother Nasir Alam Khan and one Jawed Khan was returning home and reached near Alijan Chowk, petitioner and F.I.R. named accused persons surrounded them. This petitioner is alleged to have brought gupti and handed over to co-accused Sabir Ansari. In the occurrence, informant's brother Nasir Alam Khan and Jawed Khan died.

It is submitted on behalf of petitioner that petitioner

Patna High Court CR. MISC. No.37243 of 2021(3) dt.13-01-2022 2/2 has been falsely implicated in this case. No specific overt act has been alleged against this petitioner and she is in custody since 05.08.2020.

However, learned A.P.P. for the State and counsel for the informant opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above-named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Ranjula Bharti, learned A.C.J.M. 16 cum Sub Judge 17, Hajipur, Vaishali in connection with Sarai P.S. Case No. 178 of 2020.
