JUSTICE ANIL KUMAR SINHA ORAL ORDER 30-09-2020 Heard Mr. Bindhayachal Singh, learned counsel for the petitioner and Dr. Mritunjay Kumar Gautam, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner apprehends arrest in connection with Rajpur P.S. Case No. 155 of 2019 registered for the offences punishable under Sections 366(A), 504 and 506/34 of the Indian Penal Code, 1860.

The allegation against the petitioner as per the First Information Report is that the daughter of the informant was abducted by co-accused Vishal Kumar with the help of the petitioner and other co-accused persons.

Learned counsel for the petitioner submits that

No.22991 of 2020(2) dt.30-09-2020 2/3 petitioner has not committed any offence in the manner alleged inasmuch as there was love affair between the victim girl and the co-accused Vishal Kumar. Learned counsel further submits that daughter of the informant had eloped with the co-accused Vishal Kumar and referring to Annexure-2 which is the statement of the victim girl recorded under Section 164 Cr. P.C. submits that the victim girl has not said anything against the petitioner. She has stated that she had gone to Delhi with coaccused Vishal Kumar and the petitioner only accompanied them upto Dehri.

Having heard learned counsel for the parties and taking into consideration the materials on record and the fact that the victim girl has not said anything against the petitioner in her statement recorded under Section 164 Cr. P.C., I am inclined to grant anticipatory bail to the petitioner. Accordingly, in the event of arrest or surrender before the court below within six weeks from today, petitioner, above named, shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bikramganj, Rohtas at Sasaram, in connection with Rajpur P.S. Case No. 155 of 2019, subject to

Patna High Court CR. MISC. No.22991 of 2020(2) dt.30-09-2020 3/3 the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

It is made clear that at the time of furnishing bails bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
